PROGRAM DESCRIPTION:

The Agency Chiefs Tribal Council operates agency-level community justice programs. The Agency Chiefs Tribal Council Community Justice Program is part of a strategy designed to achieve wellness and to continue developing the holistic healing process in the three member First Nations. The community justice committees guide and direct initiatives that include alternative measures programs for adults and youths, crime prevention, victim services, healing, talking and sentencing circles, and victim/offender healing.

Cree Court handles criminal matters and child protection hearings in communities across northeastern Saskatchewan, including Big River First Nation. All court proceedings are spoken in the Cree language.

Big River First Nation also offers a Fine Option Program, community corrections services, and sentencing circles/mediation programs. (Big River First Nation, Community Development Initiative – Justice)

PROGRAM DESCRIPTION:

The Restorative Justice Unit coordinates the development and implementation of community justice structures, plans and services for the eleven member First Nations of the Tribal Council (Carry The Kettle, Little Black Bear, Muscowpetung, Nekaneet, Okanese, Pasqua, Peepeekisis, Piapot, Standing Buffalo, Star Blanket and Wood Mountain First Nations) and the town of Fort Qu’Appelle. The Restorative Justice Unit will reorganize the Community Justice Program under four pillars: Technical Services, Community Development, Training, and Governance. Core restorative justice services fall under the Technical Services pillar and include mediation, circle facilitation, negotiation and administration of affiliated programs. The Community Development pillar will address the justice needs of the member First Nations. Each First Nation is unique with specific justice priorities. Community Justice Committees will identify areas of concern specific to their communities and justice development officers will assist in the research and development of appropriate solutions. The Training pillar will address capacity development within the Program. The Governance pillar will address bylaws, wills and estates workshops, natural law workshops, legal life skills and legal preparation when new laws are coming into effect. (Government of Canada)

 

Services Provided

  • Probation: As officers of the court they supervise the court orders in our communities.
  • Youth Reintegration: As a community liaison between youth released from court and their community resources.
  • Court Worker:  As liaisons between the court and the community they offer insight into the workings of the courts, court terminology and give direction to clients to obtain legal aid.
  • Community Justice: The Officers meet with the justice committees, arrange justice gatherings, provide circle facilitation, mediation, trainings.

PROGRAM DESCRIPTION:

MLTC encompasses a holistic view of the Justice system in First Nation Governments and works towards building a healthy community and lowering recidivism rates. Each of the MLFN’s house a Justice Coordinator who provides direct services to the community in which they reside. The Justice Coordinators are responsible for all mediation files, fine options plans, court appearances, and other justice initiatives within their communities. We at MLTC provide advice and direction to the Justice Coordinators on the development and implementation of community justice structures, plans and services; and works to serve as a liaison with the FSIN Indian Justice Council, the Federal and Provincial Governments and Justice sector officials. The Justice program at MLTC invests in people and their future. With the guidance of our Elders we strive towards building stronger communities, safer communities, and healthier communities. The MLTC justice staff is dedicated to the principals of restorative Justice and works effectively and arduously to bring these initiatives to the 9 MLFN’s. The MLTC Justice program works in conjunction with the MLFN’s to ensure Justice Programs are educational, we work in creating awareness, and provide training and partnerships with these communities to provide assistance, guidance, and delivery of community based justice initiatives(Meadow Lake Tribal Council)

RURAL ALTERNATIVE MEASURES

The Program coordinates the development and implementation of community justice structures, plans and services for 12 member First Nations. The Program continues the development of Community Justice Committees and the delivery of diversion programs for adults and youth using mediation, family group conferencing, healing circles and sentencing circles. The Program is also involved in other justice related activities including victim services, crime prevention, and community based correctional services that focus on offender reintegration and rehabilitation.  (Government of Canada)

 

 

 

URBAN ALTERNATIVE MEASURES

The Program provides diversion and mediation programming as an alternative to the formal court process for adult and young offenders in the City of Prince Albert, as well as nearby communities and rural areas surrounding the city. Processes utilized include formal cautioning, victim offender mediation and family group conferencing for both pre charge and post charge cases referred to the program(PAGC Justice Programs)

URBAN JUSTICE PROGRAM DESCRIPTION:

 

Alternative Measures and Extrajudicial Sanctions

 

The program is referral-based for adults and youth.

 

Alternative measures/extrajudicial sanctions programs provide effective, efficient ways of resolving disputes that involve communities in developing culturally sensitive services to promote healing and reparation. They are also a way to address crime in conjunction with the criminal justice system.

 

Opikinawasowin (Reintegration)  Program

 

The program is referral-based for ages 12-24.

 

Program mentors support and link youth and young adults to resources and support networks within the community. The program is designed to support and assist Relatives in accessing appropriate rehabilitative services to reduce the risk of gang involvement and re-offending.

 

Indigenous Court Worker Program

 

Court Workers provide information to Relatives in and out of custody and offer information on their charges and options. The Court Workers also offer resources/ information that will assist Relatives in making an informed decision.

 

Court Workers will appear on behalf of a Relative if an emergency arises. This service is only offered if given 24 hours’ notice.

 

Reintegration at Saskatoon Correctional Centre (SCC) (Pilot Project)

 

Referrals come from the Saskatoon Correctional

 

Pilot Project formed in 2020 that works with Relatives in the SCC Urban Camp, Men’s and Women’s Reintegration Units. The program’s goal is to guide our Relatives in a wrap-around holistic approach and connect them to services such as housing, education, employment, mental health, addictions, culture, etc.

Justice Programs are referral-based:

 

  • Referrals come from Crown Prosecutor, Police/RCMP for Alternative Measures/Extrajudicial Sanctions (Mediation).

 

  • Referrals for Opikinawasowin (Reintegration) Program come from Saskatoon Probation Officers.

COMMUNITY JUSTICE PROGRAM DESCRIPTION:

 

The STC Community Justice Program provides second-level support to the STC Member First Nations based upon each community’s needs and priorities. This programming includes prevention, awareness and education. The Community Justice Program is guided by Justice Committees comprised of Elders, youth, and community members.

The program follows a Restorative Justice model by receiving alternative measures (adult) and extrajudicial sanctions (youth) referrals from the Crown/RCMP for either post charge or pre-charge.

PROGRAM DESCRIPTION:

 

Restorative Justice is simply a different way of thinking about a crime and our response to deal with law breakers. We often view crime as a crime against the crown and when the law is broken it is the Crowns responsibility to deal with the offenders. Under the Restorative Justice Model, crime is viewed as an offence that breaks the relationship between individuals. The Program delivers alternative measures programming for youth and adults that are grounded in traditional First Nations values, beliefs and methods of dispute resolution. Elders and Community Justice Committees in each of the four member First Nations organize, guide and direct community justice activities. These activities include crime prevention; early intervention; healing, talking and sentencing circles; mediation and dispute resolution; alternative measures programs for adults and youth; victims services; and community based correctional services that focus on offender rehabilitation and reintegration, and victim/offender healing. (Government of Canada)

PROGRAM DESCRIPTION:

Objectives of Department

The Tribal Justice Unit is based on the belief that we as First Nation peoples can and will help our own people by holding them accountable to us, their community, not the courts. The Canadian court system is adversarial. It is based on individuals offending the Crown, not an individual. Individuals must be accountable to the people they harm, as well as the community they affect.

 

Tribal Justice Unit staff will administer and facilitate the development and implementation of a wide variety of programs and services, which will encourage and/or facilitate, equal treatment and eventual full participation of First Nations/aboriginal within the Canadian Justice system.

 

Community Based Justice Initiative

Service provided to Member First Nations only:

  • The objectives of this program are to assist Aboriginal people to assume greater responsibility for the administration of Justice in their communities
  • To reflect and include aboriginal values within the justice system; and

 

  • Over the long terms, along with other justice programs contribute to a decrease in the victimization, crime and incarceration among Aboriginal people.

 

Saskatchewan Aboriginal Courtworker Program

Services provided to any Aboriginal, First Nation, and Inuit member:

 

  • The object of this program is to ensure that the clients understand their legal rights and responsibilities with regards to their offense.
  • Courtworkers act as an intermediary between the accused and the criminal court system.
  • Courtworker provides legal information, but not legal advice.

 

YTC Youth Reintegration Program

Service provided to Member First Nations only:

 

  • Bridge the youth back into a culturally supportive network.
  • Connect the offending Youth to resources within the community that can respond to their needs. This includes elders, positive youth programs, recreational activities and positive family members.
  • Nurture First Nation Youth to become healthy, contributing individuals by introducing them to First Nations’ cultural values, beliefs and traditions.

 

 

Alternative Measures (Extra judicial Sanctions) Program

Service provided totally “Status Blind”:

 

  • Provides a community–based program for Adult and Young offenders, which utilizes victim-offender mediations, community justice forums and accountability meetings and/or conferences.
  • Increases the offender’s accountability to the victims and community.
  • Helps reduce reliance on the formal Justice System for first and second time minor offences.

 

Alternative Measures (AMP) is a pre or post charge program which diverts certain offences away from the formal court process. The offenders are dealt with through a mediation/diversion process, often including the victim (if applicable), in an attempt to resolve the crime out of court. If the matter is successfully resolved the offender will not end up with a criminal record for the offense. If the offender fails to complete the program the matter proceeds to court for further action.

The Alternative Measures Program is a community Justice Program developed and delivered by Saskatchewan Justice, Corrections and Public Safety and the Aboriginal Justice Directorate. The La Loche Alternative measures/Extrajudical Sanctions Program work with youth and adult offenders who come into conflict with the law. Alternative Measures is a program that diverts offenders away from attaining criminal records. AMP provides a venue for victims for possible reconciliation, restitution and restoration of peace and harmony. (La Loche Friendship Centre)

Youth Intervention Program

The intent of the program is to guide youth to a better understanding on how their behaviour affects others within the community, and to make amends by giving back to the community in a meaningful way. Youth involved in the program will gain a new insight into the cause and effects of their behaviour. In addition, the program may help youth to develop new skills and interests, and to seek out new training and career opportunities being offered within the community. Through our program the CYIW will be encouraging the youth involved to continue with their education, increase their participation in Addictions and Mental Health and Wellness Counselling sessions provided within the community, including life skills and to increase participation in health, cultural, and recreational projects. The Program delivers a pre and post charge diversion program for adults and youth that seeks to restore and reintroduce traditional First Nation justice practices. Programming offered through Onion Lake Native Justice:

  • Community mediation: aimed at improving communication between disputants and to help the parties reach an agreement.
  • Court-worker program: delivers services to one court point – Onion Lake – to both Aboriginal and non-Aboriginal people involved in the court system.
  • Fine-option program: an alternative to those who cannot meet the fines levied upon them by the court.
  • Youth-prevention program: provides intensive supervision for medium to high-risk young offenders to assist them with successful completion of probation or as a support for those in custody.
  • Reintegration program: developed to provide Aboriginal communities a greater role in planning for the institutional release -of membership back into their communities.
  • Alternative-measures program: emphasizes on the offender taking responsibility for their actions, and also promoting empathy for the victim(s) reparation and prevention of future harm.
  • Youth justice committee: offers young people a place in the community to address justice issues within our nation among other youth. (Program is on hold until further notice).
  • Hub committee: a collaboration between various departments in an effort to proactively address issues that are identified as a crisis with an elevated level of risk.

  • Alternative Measures Program (Mediation)

Mediation is a form of restorative justice that provides healing and harmony for people. The victim and offender meet and talk about how the crime has affected them. They also decide an agreement that works for everyone, so that the court system may be avoided.

  • Fine Option Program

If you have a fine to work off, then the John Howard Society will refer you to Whitecap. Once here, hours will be worked at Public Works or another appropriate placement.

  • Cadets Program: a crime-prevention program that collaborates with the RCMP to promote healthy activities

Workshops and group sessions are provided to individuals dealing with grief and loss.

  • SafeTALK (TM)

A four-hour training is available for all individuals wanting to learn skills in suicide prevention.

  • Whitecap Dakota Wellness FB Group

Through social media support, the Mental Health and Wellness Team consistently posts ideas and tips for individual and family wellness.

  • Yoga Therapy

Individual or group sessions are available for sharing yoga practices to reduce stress and promote healthy wellbeing.

  • Youth Arts Program

Youth are invited to participate in the expressive arts to engage in healthy practices to maintain their mental health. Jordan's Principle funds this project for youth.
